Terms & Conditions for Beauty Product Usage at Notion Online Solution Private Limited

By accessing, registering, transacting, or otherwise using any part of our platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, along with our Privacy Policy and any other applicable policies, guidelines, or instructions communicated from time to time.

1. User Responsibilities

a. Adherence to Usage Guidelines and Safety Standards
You expressly agree to use all beauty and wellness products strictly in accordance with the instructions, warnings, and recommended usage guidelines provided by the Company. These may be printed on the product packaging, contained in information leaflets, or available digitally on our website or mobile application. You understand and accept that improper usage or failure to follow specified guidelines may result in adverse outcomes such as allergic reactions, skin irritation, or other medical issues, for which the Company shall not be held liable. It is your sole responsibility to consult a licensed dermatologist or physician before using any product, especially if you have known allergies or sensitivities.

b. Obligation to Provide Accurate Information
You represent and warrant that all information you provide on the platform, including during registration, product orders, inquiries, or feedback submissions, shall be complete, accurate, and up to date. Providing false, misleading, or incomplete information may lead to immediate suspension or termination of your account, cancellation of pending orders, and may result in legal action for fraudulent representation under applicable Indian laws, including but not limited to the Information Technology Act, 2000.

c. Compliance with Applicable Laws and Platform Policies
You agree to comply with all applicable local, state, and national laws, rules, and regulations while using our products or services. Any unlawful, unethical, or unauthorized use of the Company’s platform or offerings—including misuse of promotional offers, distribution of counterfeit claims, or tampering with product packaging—shall be deemed a material breach of these Terms and may result in immediate legal consequences, including termination of services and potential prosecution under civil and criminal statutes.

2. Restrictions on Use

A. Non-Medical Usage Disclaimer
The beauty and cosmetic products made available by Notion Online Solution Private Limited are formulated and intended strictly for external, cosmetic, and topical use only. These products are not designed, marketed, or approved for any medical, therapeutic, or diagnostic purposes, including but not limited to the treatment, cure, or prevention of skin conditions, dermatological diseases, or any physical or psychological health issues. Any such use shall be at the sole risk of the user. Users with a history of medical conditions, particularly skin allergies, hypersensitivity, dermatitis, or other dermatological disorders, are strongly advised to consult a qualified medical practitioner or licensed dermatologist prior to using any such products. The Company disclaims any and all liability arising from the misapplication or off-label usage of its products for medical purposes.

B. Minimum Age Requirement
Use of our beauty products and services is strictly restricted to individuals who are 18 years of age or older. By purchasing, registering for, or otherwise using the Company’s products, you represent and warrant that you are of legal age to form a binding contract under Indian Contract Act, 1872. Any access or use of our products by individuals below the age of 18 without appropriate parental or legal guardian supervision is unauthorized and constitutes a violation of these Terms. The Company shall bear no responsibility or liability for any adverse effects or damages arising due to usage of its products by minors, whether such usage was intentional, negligent, or the result of circumvention of our age-verification protocols. The responsibility in such cases shall lie entirely with the parent(s) or guardian(s) who failed to prevent or who permitted such access, knowingly or unknowingly.

C. Usage during Pregnancy and Lactation
Pregnant and lactating women are advised to exercise utmost caution before using any beauty or personal care product offered by the Company. Certain ingredients or formulations may not be appropriate during pregnancy or while breastfeeding. It is strongly recommended that such individuals seek prior consultation with a certified healthcare professional to ensure the safety and suitability of any product prior to its use. The Company shall not be held liable for any reactive outcomes—including but not limited to allergic reactions, hormonal interference, or fetal/maternal health complications—arising from the use of products by individuals who are pregnant or breastfeeding without first obtaining competent medical advice.

3. Dispute Resolution

a. Jurisdiction and Venue: In the event of any dispute or disagreement arising from the use of beauty products or services offered by Notion Online Solution Private Limited, the matter will be subject to the exclusive jurisdiction of the courts located in Delhi, India, for any legal proceedings that fall outside the scope of arbitration. Any informal dispute resolution meetings, if agreed upon, may take place at the company’s office located in Noida, India. 

b. Mediation and Arbitration: We encourage users to attempt to resolve any disputes informally. However, if mediation fails, all disputes will be resolved through binding arbitration in accordance with the laws of India, and Specify arbitration rules which are the Arbitration and Conciliation Act, 1996, and rules of a specific institution as and when required. The language of arbitration shall be English. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties. The seat and venue of arbitration shall be Noida, India. The decision of the arbitrator will be binding.

4. Limitation of Liability

a. Exclusion of Indirect and Consequential Damages
To the fullest extent permitted under applicable laws, Notion Online Solution Private Limited, its affiliates, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, punitive, or consequential damages whatsoever, including but not limited to physical injuries, allergic reactions, rashes, inflammation, irritation, or adverse dermatological responses caused by the use or misuse of any product, even if the Company has been advised of the possibility of such damages.
This includes damages resulting from: Non-adherence to the usage instructions and safety guidelines provided on the product packaging, inserts, or official website; Use of products by individuals with pre-existing skin conditions, allergies, or medical sensitivities without appropriate medical consultation; Application of products beyond their intended cosmetic and topical use. This limitation of liability shall not apply in cases where liability arises due to proven manufacturing defects or product safety issues, and where such liability cannot be excluded under the applicable provisions of the Consumer Protection Act, 2019 or other mandatory Indian statutory requirements.

b. User’s Duty to Exercise Informed Caution
By purchasing, opening, or using any beauty product supplied by Notion Online Solution Private Limited, the user expressly acknowledges and agrees that: They have read and understood all product-related instructions, ingredients, usage guidelines, warnings, and disclaimers provided by the Company and/or original manufacturer or brand (either on the packaging, accompanying documentation, or official brand website); They accept that cosmetic product results may vary based on individual skin type, health condition, climate, and other personal factors; They undertake usage at their own discretion and risk, particularly in the absence of medical consultation for sensitive or compromised skin types. Accordingly, the Company shall not be liable for any undesirable outcomes including, but not limited to, breakouts, dryness, pigmentation, irritation, or any dermatological flare-ups arising from: Failure to patch-test prior to full application, Use on unsuitable skin types, Application in contradiction to the safety directions provided.

This clause shall not be interpreted to limit or exclude the Company's liability in cases of proven gross negligence, willful misconduct, or delivery of defective products within the meaning of applicable Indian laws, provided that such liability is duly established in accordance with judicial standards

5. Product Availability and Modifications

a. Product Availability
All products listed and offered for sale by Notion Online Solution Private Limited are subject to stock availability and operational discretion. The Company does not guarantee the continued availability of any particular product or category, and reserves the absolute right to discontinue, modify, substitute, or upgrade any product or service at its sole discretion, without any obligation to notify individual users in advance.

The Company also clarifies that all product sales are made exclusively through online platforms (such as the official website, mobile application, or authorized e-commerce partners), and no physical or offline retail outlets exist for these products anywhere in India. Any claim or representation to the contrary shall be deemed false and misleading, and the Company disclaims any responsibility or liability arising from purchases made through unauthorized or counterfeit retail channels.

b. Modification of Terms and Conditions
Notion Online Solution Private Limited reserves the right to revise, update, or amend these Terms & Conditions, product specifications, return policies, or service protocols at any time, at its sole discretion, and in accordance with evolving business, legal, or technological circumstances.
All such changes shall become immediately effective upon publication on the official company website (www.yesmadam.com) or any other designated communication platform. For material or substantial changes that may affect user rights or obligations, the Company may also issue targeted communications to registered users through digital notifications, emails, or any other practical medium, including SMS or in-app alerts.

c. Anti-Counterfeiting and Brand Integrity

Furthermore, any manipulation, misrepresentation, or alteration of brand messaging, statutory declarations, product usage instructions, promotional claims, or legal disclaimers—whether through rewording, paraphrasing, or visual editing—is strictly prohibited and shall be prosecuted to the fullest extent permissible under civil and criminal law.

The Company reserves the right to initiate legal proceedings, including:

Filing injunction suits, seeking damages and punitive relief, Lodging formal complaints with appropriate regulatory and enforcement bodies, Initiating cease-and-desist actions and intellectual property enforcement proceedings, and Pursuing criminal action where applicable, under Sections 420, 468, and 471 of the Indian Penal Code for fraudulent misrepresentation and forgery.

All such matters shall be adjudicated under the exclusive jurisdiction of competent courts in New Delhi, irrespective of the infringer’s physical location

The Company reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully in asserting any available defenses.

9. Governing Law

These Terms & Conditions, including any associated policy, disclaimer, transaction, or interaction with Notion Online Solution Private Limited, shall be governed by and construed exclusively in accordance with the laws of the Republic of India, without reference to any conflict of law principles.

You expressly agree that any disputes, claims, actions, or legal proceedings arising out of or in connection with these Terms, the use of our website, or purchase/use of our products shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India, irrespective of your current location or jurisdiction. You waive any objection to the venue of such courts on the grounds of improper forum or inconvenience.

10. Severability

If any provision, clause, or part of these Terms & Conditions is found to be invalid, unlawful, void, or otherwise unenforceable by a court or tribunal of competent jurisdiction under applicable law, such provision shall be deemed to be severed from the remainder of the Terms to the extent of its invalidity. The remaining portions of the Terms & Conditions shall continue in full force and effect, and the invalid or unenforceable provision shall, to the maximum extent permissible, be modified so as to give effect to the original intent of the parties as closely as possible in accordance with applicable law. This provision ensures that the failure or unenforceability of one clause shall not affect the enforceability of the entire agreement

11. Waiver

No failure or delay by Notion Online Solution Private Limited in exercising any right, power, or privilege under these Terms & Conditions shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or privilege preclude any other or further exercise of the same or the exercise of any other right, power, or privilege. 12. Force Majeure

Notion Online Solution Private Limited shall not be held liable for any delay or failure in performance of any part of these Terms & Conditions or any obligations therein, if such delay or failure results from events or circumstances beyond the reasonable control of the Company, including but not limited to:

• Acts of God (e.g., floods, earthquakes, storms, natural disasters);
• War, acts of terrorism, hostilities, rebellion, or sabotage;
• Civil unrest, riots, strikes, or labor disputes;
• Government actions, changes in law or regulation, embargoes, or export restrictions;
• Failure of utility services, internet connectivity, or telecommunication networks;
• Epidemics, pandemics, or quarantine restrictions;
• Fire, explosions, or accidents; or
• Shortages in materials, fuel, transportation, labor, or power supply.

In such cases, performance of the affected obligation shall be suspended for the duration of the force majeure event, and the Company shall make reasonable efforts to resume performance as soon as practicable. This clause shall not relieve the user of any payment obligations that accrued before the force majeure event.
